Terms of Service

1. About ArcTax

ArcTax ("we", "us", "our") provides web-based Making Tax Digital (MTD) software that enables sole traders, landlords, and tax agents to submit Income Tax Self Assessment (ITSA) updates and Final Declarations to HM Revenue & Customs (HMRC) via the MTD API.

By creating an account or using ArcTax you ("you", "the user") agree to these Terms of Service. If you do not agree, do not use the service.

2. Eligibility

  • You must be at least 18 years old to create an account.
  • You must be a UK taxpayer, a tax agent authorised to act on behalf of UK taxpayers, or a business operating within the MTD for ITSA regime.
  • You must provide accurate and truthful information during registration.

3. Account security

You are responsible for keeping your credentials secure. You must:

  • Use a strong, unique password.
  • Enable multi-factor authentication where offered.
  • Notify us immediately at security@arctax.co.uk if you suspect unauthorised access.
  • Not share your login credentials with any other person.

We are not liable for loss caused by unauthorised use of your account where you have failed to maintain reasonable security precautions.

4. HMRC authorisation and data submission

ArcTax connects to HMRC on your behalf using OAuth 2.0 tokens you explicitly grant. By authorising this connection you:

  • Confirm that the income, expense, and tax figures you enter are accurate and complete to the best of your knowledge.
  • Accept that submissions sent to HMRC via ArcTax are treated by HMRC as if submitted directly by you.
  • Understand that ArcTax is software only — we are not a tax adviser and do not verify the accuracy of figures you enter. You remain solely responsible for the correctness of your tax returns.

5. Subscription and billing

  • ArcTax is offered on a subscription basis. Pricing is shown on the pricing page.
  • Subscriptions are billed monthly or annually through Stripe. By subscribing you authorise recurring charges to your chosen payment method.
  • You may cancel at any time via Settings > Billing. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial periods.
  • We reserve the right to change prices with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.
  • Filing features (quarterly updates, Final Declarations) require an active paid subscription when billing enforcement is enabled.

6. Acceptable use

You must not:

  • Use ArcTax to submit false, fraudulent, or misleading information to HMRC.
  • Attempt to reverse-engineer, scrape, or circumvent any security control of the service.
  • Use automated means to access the service beyond normal usage.
  • Resell or sublicense access to ArcTax without our written permission.
  • Upload or transmit malicious code, viruses, or disruptive data.

7. Data portability and account deletion

We are committed to portability and will never hold your data hostage. You may at any time:

  • Export all your submissions and tax profile data in JSON format via Settings > Export My Data.
  • Delete your account via Settings > Delete Account. Deletion is permanent and irreversible, subject to statutory record-retention requirements.

8. Availability and service levels

We aim to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. We are not liable for HMRC API outages or downtime outside our control.

9. Limitation of liability

To the fullest extent permitted by law:

  • ArcTax is provided "as is" without warranty of any kind, express or implied.
  • We are not liable for penalties, fines, or interest imposed by HMRC arising from inaccurate data you submit.
  • Our total liability to you for any claim arising from these terms shall not exceed the subscription fees you paid in the 12 months preceding the event giving rise to the claim.
  • Nothing in these terms excludes liability for death or personal injury caused by our negligence, fraud, or any other matter that cannot be excluded by law.

10. Intellectual property

All software, design, and content of ArcTax is owned by us or our licensors. You are granted a limited, non-exclusive, non-transferable licence to use the service for your personal or business tax filing purposes only. Your tax data remains yours.

11. Termination

We may suspend or terminate your account if you breach these terms, engage in fraudulent activity, or where required by law. We will give reasonable notice where possible. On termination you may export your data for 30 days before it is deleted.

12. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to these terms

We may update these terms. We will notify you by email at least 14 days before material changes take effect. Continued use of ArcTax after that date constitutes acceptance of the revised terms.
